Regulations for the use of the moodle.webnitro.eu platform
These regulations for using the e-learning platform, hereinafter referred to as the “Regulations”, define the scope and conditions of use by users of the e-learning platform, in particular the use of an account within the e-learning platform and the conditions for using the content available on the e-learning platform, called further in the Regulations, the “Platform”, owned by Jarosław Maciejewski and part of the webnitro.eu portal.
§ 1
BASIC DEFINITIONS
- The terms used in these regulations have the following meanings:
- User – a person using the e-learning platform.
- Administrator – the entity that owns the e-learning platform, i.e. Jarosław Maciejewski (.
- E-learning platform – a web application available at https://moodle.webnitro.eu/ and via dedicated mobile applications, used for online learning, on which training materials are presented in electronic form.
- User account – a set of information about the person using the e-learning platform, which includes, among others name, surname, e-mail address of the user.
- Logging in – entering the portal with entering codes (the so-called login, i.e. User ID and password) allowing for the unequivocal identification of the User.
- Privacy Policy – a set of rules regulating the collection of data about Users and their use.
§ 2
GENERAL PROVISIONS
- By using the Platform, you accept these Regulations. The Regulations are binding for all users of the Platform, hereinafter referred to as “Users”.
- The e-learning platform is available only via the Internet and works 24 hours a day, 7 days a week, excluding periods necessary to carry out modernization works or excluding periods of failure.
§ 3
TECHNICAL REQUIREMENTS
- Using the e-learning Platform requires the User to access the Internet, a computer with an installed web browser and software necessary to use the platform.
- It is recommended to use the current versions of web browsers.
- The use of selected functionalities of the Platform is also possible using compatible tablets and smartphones.
- The Administrator is not responsible for any difficulties in using the service resulting from incorrect configuration of the User’s software or hardware, or resulting from problems with the User’s hardware or internet connection.
§ 4
TERMS OF USE OF THE PLATFORM
- In order to be able to access the Platform, the User must have an established and active user account.
- In order to be able to access the Platform, the User must have an established and active e-mail account.
§ 5
USER RIGHTS AND OBLIGATIONS
- The User has the right and obligation to use the Platform in accordance with its intended purpose, in the manner specified in the regulations, legal regulations and social and moral standards.
- The User is obliged to protect his password to access the Platform and not to disclose it to third parties.
- The user is not entitled to share didactic materials on the platform with third parties without the prior consent of the administrator.
- All correspondence, including the Administrator’s statements, will be sent to the User to the e-mail address provided by the User.
- The Administrator reserves the right to permanently or temporarily disable access to the Platform for the User in the event of using the platform in a manner inconsistent with these regulations, in particular when making access data available to third parties, as well as using the information on the Platform in a way that may cause damage to the Administrator.
- The user of the e-learning platform is bound by the rules of social coexistence and the prohibition of posting information on the Platform that violates law. Failure to comply with the rules obliges the Platform Administrator to block the User’s account. The re-allocation of the possibility to use the resources of the e-learning platform may take place only after explaining the reasons for the blocking of access.
- The User has no right to borrow, rent or otherwise distribute the didactic materials or software made available to him on the Platform, and in particular to post them on other websites, publicly play them or display them. The user has no right to copy or modify the software in any way. The user is not entitled without the consent of the administrator to use the software or content for use other than the permitted personal use referred to the Act on Copyright and Related Rights.
§ 6
PROCESSING AND PROTECTION OF PERSONAL DATA
- The administrator protects personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, The Personal Data Protection Act of May 10, 2018 and the Electronic Services Provision Act of July 18, 2002.
- The administrator uses appropriate technical and organizational measures to protect personal data against disclosure to unauthorized persons, removal by an unauthorized person, processing in violation of the law, loss, damage or destruction.
- Personal data is processed taking into account the rules provided for in the Act on the Protection of Personal Data, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC and the provisions of the regulations.
- Personal data is processed on the basis of:
- the legal obligation of the administrator,
- consent to data processing.
- The processing of Users’ personal data is undertaken for the purposes of: implementation of the didactic purpose, increasing the User’s knowledge, voting, communication between the User and the course tutor.
- The necessary data to set up an account on the Platform are: username, first name, surname, e-mail address, password. Other fields that can be completed in the User profile are voluntary data.
- Personal data collected on the platform may also be made available to relevant state authorities, at their request, on the basis of relevant legal provisions, and to entities providing services to the Administrator necessary to maintain the functionality of the e-learning platform.
- The User is entitled to:
- the right to access data, including obtaining a copy of the data,
- the right to request rectification of data,
- the right to delete data (in certain situations),
- the right to limit data processing,
- the right to withdraw consent to the extent that they are processed on the basis of consent. Withdrawal of consent does not affect the lawfulness of the processing which was carried out on the basis of consent before its withdrawal.
- The administrator also has the right to process, including collecting and storing data characterizing the way the user uses the e-learning platform in accordance with the principles provided for by law.
- The user exercises his rights through the tools provided by the Administrator on the e-learning Platform as well as by contacting the administrator.
§ 7
TECHNICAL SUPPORT
- The user reports all technical irregularities related to the use of the e-learning platform and educational materials to the administrator’s address.
- The report should contain a detailed description of the type of incident giving rise to an investigation.
- The platform administrator will make every effort to remove irregularities as technically possible as soon as possible.
- The Administrator does not guarantee that the software and content on the Platform will meet the User’s expectations and requirements and that their functioning on the User’s computer will be completely error-free and that it is compatible with any computer system on which it is used and is not responsible for any damage. User incurred as a result of improper functioning of the e-learning Platform.
§ 8
FINAL PROVISIONS
- The administrator reserves the right to change the provisions of these regulations without prior notice.
- The Regulations come into force on the day they are placed on the Platform.
- The administrator may make changes and improvements to the software and content without informing the User about it. In connection with the above, the administrator reserves the right to temporarily disable access to the Platform in order to perform the necessary work related to the maintenance and improvement of the software and content.
- The Administrator will make every effort to ensure that the frequency and time of suspending the functionality of the e-learning Platform are as least burdensome as possible for the User.
§ 9
DATA REQUEST PROCEDURE ON THE MOODLE PLATFORM
The fastest way to receive the data stored and processed on the Moodle platform is to do the following:
- Logging in to the Moodle platform.
- In the upper right corner, click on our name and surname.
- Select ‘Profile’ from the menu.
- In the ‘Privacy & Policies’ section, select ‘Export all of my personal data’.
- You will go to the export form for your private data.
- Click on ‘Save changes’. It is not necessary to provide a comment in the form.
- You will return to the ‘Data requests’ page. You will see a new entry here with the status ‘Approved’.
- You can wait for the status change (refresh page – F5) to ‘Download ready’ or come back later when you receive an email from the system that your data is ready for download.
- When the data is ready, go back to the ‘Data requests’ page.
- At the given item, click on ‘Actions’ => ‘Download’.
- The export.zip file will be downloaded to the disk.
- Unpack the file.
- Open the ‘export’ folder.
- Click 2x on the ‘index.html’ file.
- Here you will find full details of your data.
Remarks! The ready-to-download file is available for 3 days. If you forget to download, download will expire. Then go back to the data request procedure.
§ 10
PERSONAL DATA DELETION PROCEDURE
To delete your account along with personal data:
- Log in to the Moodle platform.
- In the upper right corner, click on our name and surname.
- Select ‘Profile’ from the menu.
- In the ‘Privacy & Policies’ section, select ‘Delete my account’.
- You will go to the account cancellation form.
- Click on ‘Save changes’. It is not necessary to provide a comment in the form.
- You will return to the ‘Data requests’ page. You will see a new entry here with the status ‘Awaiting approval’.
- It means that you have to wait for a response from the data controller.
Remarks!
- It may take a few days for your request to be verified, please be patient.
- You should receive the answer by e-mail. If you cannot log in to the platform, it means that your account and data have been deleted. If you can still log in, either your request has not been processed or the data deletion has been denied (you can see the status on the ‘Data requests’ page).
- If the request is not fulfilled, you can send an email to the administrator with a request to clarify the situation.
- In some cases, personal data cannot be deleted, e.g. in the case of a contract with the company, university that transfers the data to the Moodle platform and / or they are necessary for the course by its employee.
- In connection with the entry into force on May 25, 2018 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of the Directive 95/46/WE (referred to as “GDPR”), we would like to inform you about the rules for processing your personal data within the https://moodle.webnitro.eu platform.
- The administrator makes every effort to protect your personal data against unauthorized access by third parties. For this purpose, security measures are applied, including firewall, login system, physical and virtual security measures implemented by the company that maintains the Platform on its servers.
- Acting in accordance with art. 13 pt 1 and pt 2 GDPR, we would like to inform you that the administrator of your data as part of the moodle.webnitro.eu platform is Jarosław Maciejewski ().
- We process the data that you provide as part of using the platform, such as:
- information entered voluntarily by the user – by completing and sending the following forms: profile or contact modification;
- information obtained while using the portal – including:
- information in server logs – our servers automatically record data such as page requests sent by the user, date and time of the request and sending the response, browser name and version, browser language, operating system type,
- IP address – each computer connected to the Internet is assigned a unique number, i.e. an IP address; on its basis, you can, for example, identify the country from which a given user connects to the network,
- cookies (so-called “cookies”), i.e. text files created and stored on the user’s computer when visiting the website,
- information in the Moodle log – the platform’s software automatically saves information about users’ movement on the platform.
- Your personal data will be processed for the purposes of:
- implementation of the didactic purpose (based on the legal obligation of the administrator pursuant to art. 6 par. 1 letter c of the GDPR);
- increasing the User’s knowledge (based on the legal obligation of the administrator pursuant to art. 6 par. 1 letter c of the GDPR);
- voting (based on the legal obligation of the administrator pursuant to art. 6 par. 1 letter c of the GDPR);
- communication between the User and the course tutor (based on the legal obligation of the administrator pursuant to art. 6 par. 1 letter c of the GDPR).
- Providing personal data is required as necessary to provide services, and refusal to provide them will prevent their provision.
- Your personal data will be stored until the account on the Platform is deleted.
- The recipients of your personal data will only be entities authorized to obtain personal data on the basis of legal provisions and entities supporting the IT service of the platform.
- You have the right to access your personal data, the right to rectify it, delete it or limit its processing.
§1
GENERAL INFORMATION
- The service provider of the e-learning platform https://moodle.webnitro.eu, hereinafter referred to as the “Platform”, is Jarosław Maciejewski.
- The platform performs the functions of obtaining information about Users and their behavior in the following way:
- Through information entered voluntarily.
- By saving cookies in end devices (so-called “cookies”).
- By collecting web server logs by the Service Provider.
§2
GENERAL RULES
- The Service Provider pays special attention to the protection of Users’ privacy and to the protection of the confidentiality of information provided by them within the platform.
- The service provider cares in particular for the proper protection of personal data provided to him by users and does not disclose them to third parties, subject to the provisions of law, when such disclosure is mandatory.
§3
INFORMATION ON COOKIES
- What are cookies. Cookies are small pieces of text information sent by a web server and saved on the user’s side (usually on the hard drive). Cookies are most often used in the case of counters, probes, advertisements, online stores and websites that require logging in and to monitor the activity of visitors. The default parameters of cookies allow the information contained in them to be read only by the server that created them.
- The website moodle.webnitro.eu uses cookies for the purposes of:
- Statistical.
- Session (maintaining the website user’s session “after logging in”, so that the user does not have to re-enter the login and password on each subpage of the website).
- How to disable “cookies” in the web browser?
- The user agrees to save or read cookies through the settings of his web browser.
§4
SERVER LOGS
- Information about some of the behaviors of users are subject to logging in the server layer. This data is used solely for the purpose of administering the platform.
- The browsed resources are identified by URL addresses. In addition, the following may be saved:
- time of arrival of the inquiry,
- time of sending the answer,
- name of the client’s station – identification carried out by the HTTP protocol,
- information about errors that occurred during the implementation of the HTTP transaction,
- URL address of the page previously visited by the user (referrer link) – if the Website was accessed via a link,
- information about the user’s browser,
- information about the IP address.
- The above data is not associated with specific people browsing the website.
§5
MOODLE LOGS
- Information about some user behavior is logged into the Moodle layer. These data are used only to administer the website and ensure data security.
- The data is associated with logged in users.
§6
ACQUISITION OF PERSONAL DATA
- The use of the website by Users does not require providing their personal data.
- Using the form services requires providing the Service Provider with the User’s data.
§7
PROCESSING OF PERSONAL DATA
- The administrator of personal data is Jarosław Maciejewski ().
- Contact with the administrator is possible at the address indicated.
- Users’ personal data is collected and processed by the Platform only for the purpose and scope necessary for the Service Provider to provide services.
- Personal data will be made available by the Platform to other entities only in cases provided for by law or with the consent of the data subject.
- Only personal data provided voluntarily or required for the functioning of the platform is collected.
- Anyone who has provided their personal data has the right to access the content of the personal data provided, the right to correct them and delete them.
- Requests resulting from user rights can be submitted via forms on the website, as well as by contacting the data administrator.
